US Clarifies Visa Validity Does Not Determine Length Of Stay, Warns Foreign Visitors Against Overstaying

The United States government has reminded international visitors that the expiration date on a U.S. visa does not determine how long they are permitted to remain in the country, warning that overstaying an authorized visit could have serious immigration consequences.

In a recent advisory, U.S. immigration authorities explained that the duration of a visitor’s stay is determined by a Customs and Border Protection (CBP) officer upon arrival at a U.S. port of entry, rather than by the validity period printed on the visa.

According to the advisory, many foreign visitors mistakenly assume they are allowed to remain in the United States until their visa expires. However, immigration officials stressed that a visa only allows an individual to travel to a U.S. port of entry and request admission into the country.

The advisory stated, “Reminder! The length of time an international visitor is allowed to stay in the United States is determined by the Customs and Border Protection (CBP) officer upon your arrival, NOT your visa expiration date.”

Authorities urged travelers to carefully check their electronic I-94 Arrival/Departure Record, particularly the “Admit Until” date, which indicates the deadline by which they must leave the United States.

Officials emphasized that the I-94 record, rather than the visa’s expiration date, serves as the official document governing the length of an authorized stay.

The U.S. government also cautioned that remaining in the country beyond the date specified on the I-94 could constitute an immigration violation.

According to the advisory, such violations may negatively affect future visa applications and an individual’s ability to enter the United States again.

The advisory further encouraged all international visitors to verify their I-94 records immediately after arriving in the country to ensure they understand the duration of their authorized stay and remain compliant with U.S. immigration laws.

The reminder forms part of ongoing efforts by U.S. immigration authorities to reduce cases of visa overstays and improve awareness of entry and departure requirements among foreign travelers.
