The High Court of the Federal Capital Territory (FCT) has ruled against the federal government of Nigeria, awarding a cost of N100 million for violating the right to personal liberty of the former governor of the Central Bank of Nigeria (CBN), Godwin Emefiele.

Justice Olukayode Adeniyi issued the ruling on Monday while presiding over a fundamental right enforcement suit filed by Emefiele. The suit challenged his unlawful detention by agents of the federal government, including the Department of State Services (DSS) and the Economic and Financial Crimes Commission (EFCC).

In addition to the cost awarded, Justice Adeniyi imposed a restraint on the federal government, prohibiting further re-arrest of Emefiele without an order of the court. The ruling emphasized the need to halt the unlawful practice of arresting individuals before investigations are conducted.

The decision by the High Court signals a move towards protecting individuals’ fundamental rights and promoting a legal framework that ensures due process in legal proceedings. Further details on the ruling are expected to be provided as the case unfolds.
